Collingwood’s boardroom brawl will go before a Supreme Court judge at the end of this month.
Supreme Court Justice Peter Riordan has been allocated to oversee a proceeding brought by long-time Magpies solicitor Francis Galbally against president Mark Korda and his board.
Galbally is seeking access to the club’s register of members as part of a bid to support businessman Jeff Browne’s proposed takeover of the board.
Justice Riordan will set out a timetable for a hearing — likely to be held in late September or October — and make orders for the filing of submissions on August 27.
Galbally’s high-powered legal team have accused Collingwood of breaching section 173 of the Corporations Act in refusing to disclose the membership register.
Galbally, who has engaged leading corporate lawyer James Macdonald from Piper Alderman, top silk Chris Blanden QC and commercial barrister Tim Dowling, claims the Magpies are attempting to stonewall a democratic club election.
Collingwood has also lawyered up, engaging top dispute resolution lawyer Leon Zwier of Arnold Bloch Liebler to assist in the stand-off.
Galbally was the Magpies’ honorary solicitor from 1976-94 and is a prominent Melbourne businessman.
“I have become increasingly concerned about the governance and overall direction of the club,” Galbally said in an affidavit filed with the court last month.
“A number of key issues have arisen recently, including not only the direction of the club and its football department, but also the purported appointment of Ms Bridie O’Donnell as a director of the club, the resignation of Mr Nathan Buckley as the senior coach of the club, and issues related to the handling of the club’s salary cap.”
In a change of tactics unveiled last week, Browne, 66, said he would now seek to spill all seven Collingwood board positions at the club’s annual general meeting on December 16.
Browne’s bid to force a spill at the AGM will only involve the gathering of 100 fresh signatures instead of the higher hurdle of five per cent of the club’s members needed for an extraordinary general meeting.
The register of members is needed by the Browne camp to verify the signatures required to requisition resolutions to be put to the December AGM.
